Title: question on community grounds usage?

my local community has had a community grounds area for the last 50 years or so and for at least the last 30 years there has been 1 section that has been used for atv and dirt bike use. heres the question an older guy recently inherited a house and land bordering the grounds and has been causing some problems at the community meetings over the atvs and dirt bikes. so the community trusties of which im 1 have got together and decided its time for some rules mostly time and day restrictions. but this guy wont back off or compromize at all. now he is saying that we should have to have insurace to cover any liability.  the grounds are deeded to the community with the 7 trusties only as basically community leaders. if someone was to sue could they come after us? i dont have the money to go talk to a lawyer. but from what i can find even if someone did sue they could only come after the community club funds of which there is non. any of you guys happen to be a lawyer and can give any input? thanks

Ugh...sounds like a shitty situation...

I'm no lawyer but I would think at least time restrictions like you've tried would be a step in the right direction.  

Also, he should've known where and what he was buying into.  Nothing worse than someome coming into a situation like this and causing problems with something that's worked fine for so long...

if you call a lawyer and schedule an appt you should get a 30 min free consultation.. pretty much 30 mins to ask a thousand questions  and then just act like your gona be coming back for more.. lol.. ive done it before.. i dont know much about that legal stuff though.. try the 30 min free lawyer method lol

I would at least have everyone sign a waiver that says ride at you're own risk. Ect. Ect.

so the guy lives next door, and is trying to force you to make rules on your (the communities) property? that would be like my neighbor trying to tell me i have to get rid of my trampoline because its too dangerous for him to live next door to. if there is no rules about it in your local city code or such, i would tell him to get bent. some people seem like they have nothing better to do then meddle in other peoples business.

Assuming there is down range safety. I would propose that any regulation would have to include a range (gun) day once a week, to better serve the community of course.

This is the way to do it. But unless the form is written up by a lawyer, it's pretty much worthless.

My family had a lawyer write up a liability form for people who we bring to ride on our property. Luckily we haven't had to enforce it yet.

If theres no rules now, if you institute some, then you'll have to follow them closely & make sure everybody on the community grounds are doing so. Do you want to camp out there 24 hours a day to be sure every body complies.
No rules, nothing to enforce.

It is kinda like having regular drivers license & driving a diesel pusher motor home & long enclosed trailer, which you really need a class B license to be legal, but if you go all the way & get CDL license, if cop stops your rig, you fall under all the CDL rules, log book & crap like that.
In the state of NC, when under CDLs, if theres a wheel & tire does not have a valve stem cap in place, that is an instant $50.00 fin on the spot. Regular license, nothing would be said.
Just kinda giving you an idea in a round about way.

thanks for the input guys. we hadnt thought of the waiver idea. and ill also look in to the 30 min lawyer thing. the rules we would make would basically be no riding on wed. or sunday as there is a church that also borders the property. and maybe no riding after a certain time at night. enforcing the rules shouldnt be too hard as 1 of the trusties lives on the access road and we are going to block off the only other entrance. thanks again
